Terms of Service

EFFECTIVE OCTOBER 8, 2026

These Terms are an agreement between Worker Efficiency LLC, a Nevada limited liability company ("Worker Efficiency," "we," "us"), and the company that signs up for Worker Efficiency ("your company"). They cover our website, web dashboard, and iPhone and Android apps, and they replace any earlier terms shown in our apps. We've kept them as plain as we can — please read them.

The short version

  • You pay per seat, per month. Every person who signs in needs a seat.
  • Your plan renews every month until you cancel. Deleting your account in the app does not cancel it.
  • Your company owns its data. We use it only to run, support and improve the service for you, or when the law requires it.
  • You're responsible for telling your crew what the app records, and for paying them correctly.

Who can sign up

Worker Efficiency is for business use. To sign up a company you must be at least 18 and allowed to agree to these Terms for that company; when you do, your company is agreeing to them. People your company invites — workers, foremen, office staff — use Worker Efficiency through your company's account. They agree to the parts of these Terms about logins, acceptable use, disclaimers, limitation of liability and disputes.

You accept these Terms when you create an account, or start or pay for a plan.

The service

Worker Efficiency gives companies and the workers they invite tools for time tracking, job costing, estimating, scheduling, forms, equipment, inventory, training, certifications and peer reviews. Which features you get depends on your plan. We may add, change or remove features, and the mobile app can update itself in the background.

Logins

  • Each person needs their own login. Logins can't be shared.
  • Keep passwords private. Your company is responsible for what happens under its users' logins, and for removing people who leave.
  • Tell us right away if you think an account was misused.

Plans, seats and prices

  • You choose a plan (Standard or Premium) and a number of seats. Every person who signs in needs a seat, and you can't invite more people than your seats cover.
  • Seats come in packs: 1 seat, then 5, 10, 15 and so on up to 200.
  • Prices are per seat, per month, in US dollars, as shown on our pricing page. If the law requires us to collect sales tax, we'll add it to your invoice.
  • If you add seats or change plans, the new price starts on your next billing date. We don't charge or refund part-months for the change.

Trial periods

Your company's first plan starts with a trial period of 7 days (or 30 days if we've invited you to a longer one). We ask for a card to start it, and we don't charge during it. When the trial ends, your plan starts automatically and we charge that card the monthly price for the plan and seats you picked, every month until you cancel. To avoid any charge, cancel before the trial ends.

Automatic renewal and cancelling

  • Your plan renews automatically every month, and we charge the card on file each month until you cancel.
  • To cancel, your company's admin can email us at help@workerefficiency.com and we'll confirm by email. If your email reaches us before your next billing date, we won't charge you again, even if our reply comes later. Your plan stays active until the end of the period you've already paid for, then stops.
  • While your plan is active, your admin can update the card and see invoices under My Subscription → Manage billing in the web dashboard. If a payment has failed and that button isn't showing, email us and we'll help you update the card.
  • Deleting your account or your company in the app does not cancel your plan. Cancel first.

Refunds

Payments aren't refundable. If you cancel, you won't get money back for the rest of the month or for unused seats, unless the law requires it.

Failed payments

If a payment fails, we may lock your company's access to the app until it's paid. Locking access doesn't delete your data.

Price changes

We may change our prices. We'll email your admin at least 30 days before a new price applies to you. If you don't want it, cancel before then.

Plans bought through Apple

If your company bought a plan inside our iPhone app, Apple bills it, and Apple's terms cover payment, renewal, cancellation and refunds for that purchase. Manage it in your Apple account settings.

Your data

  • Your company owns the data it puts into Worker Efficiency: jobs, timesheets, forms, photos, costs and the rest.
  • You give us permission to store, copy, process and show that data only to run, support, secure and improve the service for you, and when the law requires it.
  • We handle personal information as our Privacy Policy describes. We don't sell your data.
  • Each user's own profile belongs to that user. If an owner deletes a company from its settings, each of its verified members keeps a short work-history summary on their profile: company name, role, dates, total hours and number of jobs.

When your plan ends

When your plan ends, the app is locked, but we keep your company's data so you can come back. Download anything you need — like timesheets and reports — before your plan ends, because exports aren't available while the app is locked. To have your company's data deleted, the account owner can email us. Some copies may remain in backups, or where the law requires us to keep them.

Your responsibilities as an employer

You're responsible for how your company uses Worker Efficiency with your crew, including:

  • telling your workers what the app records and getting any consent the law requires — including their device's location (phone or browser) at clock-in and, depending on the features you use, at clock-out, task start and finish, form submissions and equipment use;
  • getting permission before uploading other people's photos, signatures or documents;
  • following wage-and-hour laws — paying for all time worked, overtime, and meal and rest breaks — and keeping the payroll records the law requires;
  • checking timesheets and hours before you pay anyone. Worker Efficiency helps you track time and costs; it isn't a payroll service.

Acceptable use

Don't share logins; try to get into accounts or data that aren't yours, or scrape other companies' data; probe or test our security without our written permission; copy the service, take it apart to see how it's built, or resell it; upload viruses, harmful code or unlawful content; use reviews, comments or uploads to harass anyone; or use Worker Efficiency to break employment, privacy or other laws. If you find a security problem, please tell us.

Our software and your feedback

We own Worker Efficiency — the apps, website, software, designs and our training library. Your plan gives your company a limited right to use them while the plan is active. That right can't be sold or handed to another company. If you send us ideas or feedback, we may use them without owing you anything.

Other companies' services

Worker Efficiency relies on other companies, such as Stripe (payments), Apple and Google (app stores, push notifications and maps), Amazon Web Services (hosting, storage and text messages) and Mux (training videos). Their own terms apply to their services, and we aren't responsible for them. Downloading our apps is also covered by the App Store's or Google Play's terms.

Availability

We work to keep Worker Efficiency running, but we don't promise it will always be available or error-free, and we don't promise it will be up a set amount of the time. We may take it down for maintenance.

Disclaimers

Worker Efficiency is provided "as is" and "as available." As far as the law allows, we make no promises about it beyond what these Terms say — including that it's accurate, uninterrupted, error-free, of good quality ("merchantable") or fit for a particular purpose. In plain terms:

  • Numbers are only as good as what your team enters. Job costing, margins, estimates, pay rates, timesheets and exports are tools — check them before you rely on them. They aren't accounting, tax, legal, payroll or HR advice.
  • GPS isn't perfect. A phone's location can be off, late or missing. Don't treat a single reading as proof of where someone was.
  • This isn't a safety system. Safety forms, checklists and training help organize your safety program; they don't replace it, required training, a competent person on site, or emergency services. Unless a course clearly says otherwise, our training isn't an official OSHA Outreach (10- or 30-hour) course.
  • Peer reviews and ratings are opinions from coworkers and managers. We don't check them.

Limitation of liability

As far as the law allows: (1) we aren't responsible for indirect, incidental, special, consequential or punitive damages — that is, knock-on losses such as a job you lose, a fine you get or a payroll mistake made because of a problem with the app — or for lost profits, revenue, data or business, even if we were told they could happen; and (2) our total responsibility for all claims about Worker Efficiency is limited to the greater of what your company paid us in the 12 months before the claim, or $100.

Your company protects us

If someone makes a claim against us because of your company's data, the way your company uses Worker Efficiency with its workers (including wage-and-hour, privacy, location or employment claims), or your company breaking these Terms, your company will defend us and pay any resulting damages, settlements and costs, including reasonable lawyers' fees. This doesn't cover claims caused by our own breach of these Terms. We'll tell you promptly about the claim, let you run the defense, and won't settle it in a way that costs you money without your OK.

Suspending or ending an account

Your company can stop using Worker Efficiency at any time by cancelling. We may suspend or close an account if fees aren't paid, if someone breaks these Terms, or if we need to in order to protect the service or other customers, or to comply with the law. When we reasonably can, we'll warn you first.

Disputes

These Terms are governed by Nevada law, even if your company is in another state. Any dispute will be decided only in the state or federal courts located in Nevada, and both sides agree to those courts. Before starting a case, contact us and give us 30 days to try to fix the problem.

Changes to these Terms

We may update these Terms. We'll post the new version here with a new date, and for important changes we'll email your admin before they take effect. If your company keeps using Worker Efficiency after that, the new Terms apply. If you don't agree, cancel before they take effect.

General

These Terms and anything you agree to at checkout are the whole agreement about Worker Efficiency. If something at checkout conflicts with these Terms, these Terms win. Our Privacy Policy explains how we handle personal information. If one part can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given it up. Your company can't transfer these Terms without our written OK; we may transfer them as part of a merger, sale or reorganization. Neither side is responsible for delays caused by things outside its reasonable control, but that doesn't excuse paying fees. We send notices to your admin's email; send notices to us at the email below.
